A non-bailable arrest warrant and warrant to seize against CPM leader and MLA TV Rajesh. Thiruvananthapuram Judicial first-class magistrate Court declared the decree against MLA. Museum police aren’t willing to arrest Rajesh, who is residing at the MLA hostel. T V Rajesh continues his routine, without any hassle including his participation in Assembly sessions, with a sound arrest warrant against him.
Magistrate G S Midhun Gopi ordered museum Circle Inspector to arrest and produce the accused, within twenty-third March before the Court. The Court has additionally directed the Village Officer to seize the movable and immovable assets of Rajesh. The incident happened within the year 2012. CPM party leader TV. Rajesh MLA. P Biju, K S Sunil Kumar, and SP Deepak are the accused within the case. As per the case filed CPM leader and activists,
Unjustly made a group at museum junction and had halt pedestrians and vehicles inflicting traffic jam and the gang damage public property.
Museum police on the very same day have charged a case within the station with crime number 1260/2012. A charge sheet was submitted on the case while completing an investigation in the year 2014.
The charge sheet was filed underneath section 3 (2) (C) of 1984 public property damage hindrance Act and under sections 143, 147 and 149 of the Indian penal code.
The Court accepted the case file on 3rd February 2014 and ordered to produce the accused in the Court. Following the failure to produce the MLAs before the Court, the arrest warrant was issued against the criminals.
However, museum SI in fear of the CPM MLA always reverted to the Court’s arrest warrant with reports portraying false reasons like ‘could not meet the suspect’ ‘accused is hiding’ ‘residence of the accused remains locked’ and ‘neighbors claim that the accused is no longer lives here’.
Museum CI and also the police are afraid to arrest T V Rajesh who lives at the residence of legislators, at Neyyar block 7 D.
The inactivity and negligence of the museum police have been evident to the Court, which is why the Court moved to critical actions within the case.
The Speaker of the Assembly was never notified by the CI about the arrest warrant issued against MLA. Veiling the warrant MLA attends to the Assembly sessions. The police need the Speaker’s permission only for arrest during the assembly.
Earlier warrants against Kadakampally Surendran was reverted to the Court in the same way, Thiruvananthapuram additional Chief Judicial Magistrate Court had declared Kadakampally as the most wanted criminal. Following which, Kadakampally surrendered at the Court, apologized and sought bail.
